1. Definitions
- "We", "Us", "Our" — Akar Tensor Sdn Bhd, the company operating the programmes described on this website.
- "You", "Participant" — an individual who enquires about, registers for, or enrols in a programme.
- "Programme" — any evening course or short course offered by Akar Tensor, as described on the Solutions page.
- "Materials" — session recordings, notes, exercises, code examples, and any other content provided as part of a programme.
- "Agreement" — these Terms and Conditions, together with any confirmation email or enrolment agreement issued to you.
2. Acceptance of terms
By submitting an enquiry form or completing enrolment in a programme, you agree to these Terms and Conditions. If you are enrolling on behalf of an organisation, you represent that you have authority to bind that organisation to these terms.
You must be at least 18 years of age to enrol. By enrolling, you confirm that you meet this requirement and have the legal capacity to enter a binding agreement under Malaysian law.
3. Programme description and availability
We offer evening programmes in artificial intelligence development, delivered in person at our Kuala Lumpur premises. Programme descriptions, including syllabi, prerequisites, time commitments, assessment methods, and scope limitations, are published on the Solutions page of this website.
Programmes are subject to minimum enrolment. If a cohort does not reach the minimum number of participants, we reserve the right to cancel it. In that event, we will offer a full refund or transfer to the next available cohort.
Sessions are delivered in English. Participants should be comfortable with technical content in English to participate effectively.
4. Enrolment and access
Enrolment is confirmed upon receipt of full payment and our written confirmation. Access to session recordings and materials is provided to confirmed participants for the duration of the cohort. Access expires when the cohort ends.
You are responsible for maintaining the confidentiality of any login credentials we issue. You may not share access with third parties. If you suspect unauthorised use of your access, you must notify us promptly.
We may refuse or revoke enrolment if a participant is found to have misrepresented their prerequisites or to be in breach of these terms.
5. Participant responsibilities
- Attend or review sessions in a manner consistent with learning effectively.
- Submit assessed work that is your own. Submitting another person's work as your own is grounds for removal from the programme without refund.
- Interact with instructors and other participants in a professional manner during live sessions and in any shared communication channels.
- Not reproduce, distribute, or publicly share programme materials without our written permission.
- Bear any third-party costs associated with the programme (such as API costs stated in the programme description).
6. Intellectual property
All programme materials, including session recordings, exercises, code examples, and instructional content, are the intellectual property of Akar Tensor Sdn Bhd. We grant you a limited, non-exclusive, non-transferable licence to use these materials for your personal learning during the programme. This licence does not extend to redistribution, resale, or use for training other individuals.
Open-source libraries and tools used in the programmes remain subject to their respective licences.
7. Payment
All fees are stated in Malaysian Ringgit (RM) and are payable in full prior to the start of the cohort. Payment methods accepted are stated at the point of enrolment.
Refund policy: A full refund is available if you withdraw more than 14 days before the first session. A 50% refund is available if you withdraw between 7 and 14 days before the first session. No refund is available for withdrawals within 7 days of the first session or after the programme has begun. If we cancel a cohort, a full refund will be issued.
Third-party costs (such as API fees for the LM Engineering programme) are not included in the programme fee and are not refundable through us.
8. Completion record
Participants who submit all assessed work will receive a completion record from Akar Tensor Sdn Bhd. This record confirms participation in and completion of the programme. It is not an industry qualification, professional credential, or accredited certificate. We make no representation about how third parties will regard this record.
9. Disclaimers
Programmes are provided on an "as is" basis. We do not make any representation about the outcomes you will achieve from completing a programme. Learning outcomes depend on your effort, prior knowledge, practice after the programme, and factors outside our control.
Programme content reflects the state of the relevant technologies at the time of delivery. The AI development field changes quickly; some specific tooling or APIs may change between cohorts.
10. Limitation of liability
To the fullest extent permitted under Malaysian law, our total liability to you in connection with any programme is limited to the fee you paid for that programme. We are not liable for indirect, consequential, or incidental losses, including loss of earnings or business opportunities.
We are not liable for failure to perform obligations due to circumstances outside our reasonable control, including but not limited to natural disasters, utility failures, or venue closures. In such cases, we will endeavour to reschedule affected sessions.
11. Indemnification
You agree to indemnify and hold harmless Akar Tensor Sdn Bhd, its instructors, and staff from any claims, losses, or expenses arising from your breach of these terms or your misuse of programme materials.
12. Termination
We may terminate your access to a programme immediately if you are found to have submitted work that is not your own, shared access credentials, disrupted the learning environment for other participants, or breached these terms in any material way. In such cases, no refund will be issued.
You may withdraw from a programme at any time subject to the refund policy in section 7.
13. Governing law and dispute resolution
These terms are governed by the laws of Malaysia. Any dispute arising from these terms or your participation in a programme will first be addressed through direct communication between you and us. If not resolved within 30 days, either party may refer the matter to mediation through the Malaysian Mediation Centre (MMC) before proceeding to litigation.
The courts of Kuala Lumpur, Malaysia have jurisdiction over any dispute that proceeds to litigation.
14. General provisions
- Entire agreement: These terms, together with the programme description and enrolment confirmation, constitute the entire agreement between you and us in relation to the programme.
- Severability: If any provision of these terms is found unenforceable, the remaining provisions continue in effect.
- Waiver: Failure to enforce any provision of these terms does not constitute a waiver of that provision.
- Assignment: We may assign these terms to a successor entity. You may not assign your enrolment without our written consent.
15. Changes to these terms
We may update these terms from time to time. The date at the top of this page indicates the last update. For material changes that affect enrolled participants, we will communicate the change by email before it takes effect. Continued participation in a programme constitutes acceptance of the updated terms.
